Terms & Conditions
Welcome to MagiCavern (hereinafter “Game”). These Terms & Conditions (“Terms”) are a legally binding agreement between you (“User”, “you”) and NextByte Market UAB (“we,” “us,” “our”). By registering, accessing, or using the Game in any way, you agree to be bound by these Terms. If you do not agree, do not register or use the Game.
1. Definitions
- Account — your user account created when you register via email and verify it through email confirmation.
- Virtual Currencies / Virtual Items — internal game assets, including but not limited to Crystals, Coins, Diamonds, Character Cards.
- Purchase — acquisition of Virtual Currencies / Virtual Items by paying real money (EUR).
- Developer — NextByte Market UAB, Bausko gatve 7-49E, Venta, LT-85327 Akmenes r., Registration code: 307071750.
- Extraordinary Circumstances — technical errors, unauthorized transactions, fraud, system malfunctions, or other exceptional cases outside regular operations.
2. Registration, Account, and Verification
- To use most features of the Game, you must register by providing a valid email address and other required information.
- After registration, you must verify your email via a confirmation link sent to your provided email. The account is not fully active until verification is complete.
- You must provide accurate and truthful information. You are responsible for keeping your account information updated.
- You are fully responsible for keeping your login credentials secure and notifying us immediately of unauthorized access.
3. Use of the Game
- We grant you a non-exclusive, non-transferable, revocable license to access and use the Game for personal entertainment.
- You agree not to use the Game to cheat, hack, exploit bugs, use bots, harass others, or engage in illegal activities.
- You must be of legal age under your country’s laws to use services involving monetary transactions, or have parental consent if you are a minor.
4. Virtual Currencies / Virtual Items
- The Game includes the following Virtual Items: Crystals, Coins, Diamonds, Character Cards.
- Virtual Items may be obtained through gameplay, promotions, or direct Purchase in EUR.
- Virtual Items are purely virtual, have no real-world value, and cannot be exchanged for real money.
- All Purchases of Virtual Items are final. Once delivered, they cannot be returned or refunded except in Extraordinary Circumstances.
- In case of Extraordinary Circumstances, Users must fill out a refund request form and contact support@magicavern.com with evidence.
5. Payments & Billing
- All Purchases are conducted in Euros (EUR). Prices will be shown before confirmation.
- We do not charge additional commission or payment processing fees.
- If a payment fails, we are not obliged to deliver Virtual Items until payment is confirmed.
6. Updates, Maintenance, Downtime
- We may perform maintenance, scheduled or unscheduled, during which the Game may be unavailable.
- Service interruptions may occur. While we aim for high availability, uninterrupted service is not guaranteed.
- We may update the Game, add or remove features, change Virtual Items, mechanics, or rules.
7. Intellectual Property
- All Game content—graphics, sound, characters, code, user interface—is owned by NextByte Market UAB or licensed to it.
- You may not copy, distribute, sell, translate, decompile, or create derivative works from our content.
8. Termination, Suspension, and Account Actions
- We may suspend or terminate your account if you violate these Terms.
- You may stop using the Game at any time and request deletion by contacting support.
- Upon termination, you lose access to your account, Virtual Items, and associated content, without compensation.
9. Disclaimers and Warranties
- The Game is provided ‘as is’ to the extent permitted by law. We disclaim all warranties except those required under applicable law.
- We do not guarantee perfect performance or that the Game will be error-free.
10. Limitation of Liability
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- We are not liable for loss of data, loss of Virtual Items, lost profits, or damages due to account suspension or service delays.
- Our total liability in any 12-month period shall not exceed the amount paid by the User for Virtual Items during that period.
11. Changes to Terms
- We may modify these Terms. Changes will be posted in the Game and/or on our website.
- If changes are material, Users may be notified via email. Continued use constitutes acceptance of the new Terms.
12. Governing Law and Dispute Resolution
- These Terms are governed by the laws of Lithuania, without regard to conflict of laws principles.
- Disputes shall be subject to the exclusive jurisdiction of the courts located in Lithuania.
13. Severability
- If any provision of these Terms is invalid or unenforceable, the remainder shall continue in full force and effect.
14. Entire Agreement
- These Terms, together with the Privacy Policy and any rules we publish, constitute the entire agreement between you and NextByte Market UAB.
